Conditions of Participation for the Fit for Work campaign

The Fit for Work campaign begins on 01.05.2024 and ends on 31.07.2024. All participants who are active for at least 20 days or have covered 200 km distance during the campaign period and have documented their activity in the campaign calendar by 15.08.2024 at the latest will automatically be entered into the competition.

Active kilometers are all distances actively covered (e.g. walk during lunch break, bike ride to the supermarket, bike ride or run). The type of travel can be freely selected. The kilometers can be counted on any days (working days, weekends, holidays, vacation days).

  1. Scope of application and eligibility for participation, duration and end of activities
    1. These conditions of participation apply to participation in the competition of Bertelsmann SE & Co. KGaA, which are offered as part of the Fit for Work campaign by the department Sport und Gesundheit with the support of the Bertelsmann BKK. In this respect, the organizer is Bertelsmann SE & Co. KGaA, Carl-Bertelsmann-Straße 270, 33311 Gütersloh (hereinafter referred to as "Bertelsmann").
    2. Unless otherwise stated in the context of an individual competition, all employees of Bertelsmann or of companies affiliated with Bertelsmann at national level are eligible to participate in the competition. Employees of the Bertelsmann Sport und Gesundheit and Bertelsmann BKK are excluded.
    3. All participants may only enter with one contact address (private or company e-mail address) and may only win once per competition.
    4. Only those who have filled in their campaign calendar completely and by the deadline may take part in the competition.
    5. Participation in the competition is free of charge.
  2. Determination of winners
    1. The winners of each competition will be determined by drawing lots from among all eligible participants after the end of the campaign period, unless otherwise stated in the context of an individual competition, and will then be notified of their won prizes and the manner in which the won prizes are to be handed over at the e-mail address provided (see section 1.3).
    2. Prizes will then be sent promptly to the postal or company address provided by e-mail, unless otherwise stated in the prize notification.
    3. Insofar as the winner must specify a prize in more detail (e.g., clothing size, color), Bertelsmann is only obligated to make up to two attempts to contact the winner using the contact data provided upon entry. If a winner does not provide a corresponding response within a period of one day for events and otherwise within seven days after sending the prize notification or a corresponding query, or if a prize sent is returned by the shipping service provider, e.g. due to incorrect/incomplete address or non-collection, Bertelsmann is entitled to draw another winner. The previous claim to the prize shall be forfeited in this respect.
    4. The winners and their company affiliation will be named in an article on the intranet of Bertelsmann SE & Co. KGaA, provided that the winner has given his/her consent to this. The purpose of the publication is the final communication of the campaign.
  3. Exclusion from the competition
    1. Bertelsmann is entitled to cancel competitions or exclude participants from competitions, if they provide false information, manipulate the competition in an unfair manner or violate these conditions of participation.
    2. Bertelsmann's rights under section 3.1 shall also apply if reasons outside of Bertelsmann's sphere of influence, e.g. of a technical nature, make it impossible to continue the competition.
  4. Data Protection
    1. The processing of personal data is required for participation in the competition. In principle, the name and contact data, postal or company address and/or e-mail address are required. Without this data, Bertelsmann cannot identify the participants and, if they have won, provide the prize to them.
    2. Participants' data will not be passed on to third parties. This does not apply if the prize (e.g. event, non-cash prize) is sponsored by a third party and the third party requires the participant's data for the provision or distribution of the prize.
    3. In principle, the participant's data will be deleted after the end of the competition. This does not apply to the data of the winners, which Bertelsmann is legally obligated to store.

  5. Final Provisions
    1. The prizes are provided to Bertelsmann by sponsors. Bertelsmann accepts no liability for the performance of such partners as sponsors. There will be no payment of prizes in cash or substitution of prizes, unless otherwise stated in the prize notification.
    2. Bertelsmann does not store the conditions for participation for the competition of the participants as part of the Fit for Work campaign. However, as part of their participation in the competition, participants have the option of accessing these terms and conditions via the website and saving them locally.
    3. By participating in the competition, the participant accepts these conditions of participation.
    4. The legal process is excluded.
    5. These terms and conditions of participation in the competition are subject to German law with the provison that mandatory consumer protection law in the country in which the participant is domiciled remains unaffected and takes precedence.
